Welcome to FurryTales_Shop! The terms “we”, “us” and “our” refer to FurryTales_Shop. FurryTales_Shop operates this store and website, including all related information, content, features, tools, products and services, to provide you, as a customer, with a personalised shopping experience (the “Services”). FurryTales_Shop uses the Shopify platform, which enables us to provide the Services.

The following terms and conditions, together with the policies referenced in them (the “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

When you place an order, you make an offer to purchase. FurryTales_Shop reserves the right to accept or reject your order for any reason and at its discretion. Your order is accepted only after written confirmation from FurryTales_Shop. We must receive and process your payment before your order is confirmed. Please review your order carefully before submitting it, as FurryTales_Shop may be unable to accept cancellation requests once an order has been confirmed. If we reject, modify or cancel your order, we will attempt to contact you using the email address, billing address and/or telephone number provided when the order was placed.

Your purchases are subject to the return or exchange conditions set out in our Refund Policy.

You represent and warrant that your purchases are intended for personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged for a product or service will be the price in effect when the order is placed and will appear in your order confirmation email. Unless expressly stated otherwise, displayed prices exclude taxes, delivery charges, handling fees, customs duties and import charges.

You agree to promptly update your information, including your email address, credit-card numbers and expiry dates, so that we can complete your transactions and contact you when necessary.

You represent and warrant that: (i) your credit-card information is true, correct and complete; (ii) you are authorised to use the card for the purchase; (iii) charges incurred by you will be honoured by your card issuer; and (iv) you will pay all charges at the displayed prices, including delivery and handling charges and all applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. All delivery times provided are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs procedures or events beyond our control. Title to and risk of loss for products pass to you when the products are handed to the carrier.

SECTION 6 — INTELLECTUAL PROPERTY
Our Services, including without limitation all trademarks, brands, text, displays, images, graphics, product reviews, video and audio content, and their design, selection and arrangement, are owned exclusively by FurryTales_Shop, its affiliates or its licensors. All other names, logos, product and service names, designs and slogans appearing on the Services are trademarks of their respective owners.

You may be given access to customer tools offered by third parties as part of the Services. We do not monitor those tools and have no control over or input into them.

You acknowledge and agree that we provide access to such tools “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third-party tools.

FurryTales_Shop is powered by Shopify, which enables us to provide the Services. However, all sales and purchases made through our Store are made directly with FurryTales_Shop. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and FurryTales_Shop, including any injury, damage or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchase and transaction with FurryTales_Shop.

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify’s Privacy Policy, available here. By using the Services, you acknowledge that you have read these privacy policies.

We reserve the right to terminate this agreement or your access to the Services, or any part of them, at our sole discretion, at any time and without notice. You remain liable for all amounts due up to and including the date of termination.

The following sections will survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provision that by its nature should survive termination.

We will notify you of any claim covered by this indemnity, provided that a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced by that failure. We may control the defence and settlement of any claim at your expense, including the choice of legal counsel, but we will not settle a claim that imposes non-monetary obligations on you without your consent, which may not be unreasonably withheld.
